The defense attorney for a high school track coach charged with sexually abusing one of her male athletes has demanded the return of more than 200 photos seized as evidence.

The attorney, David Terry, said the photos of his client wearing lingerie are not relevant to the case. He subpoenaed Coos County District Attorney Paul Frasier and Coquille Police Chief Mark Dannels to appear in court Tuesday to return them. "The photos contain no sexual activity or other people in the photographs," Terry said.

The Register-Guard newspaper reported that the matter went unresolved Tuesday because Terry's subpoenas were for the chief and district attorney to appear in Coquille, where he thought Wendy Boutiette, 36, was to be arraigned on three counts of felony sex abuse.

The hearing was in North Bend, where Boutiette pleaded not guilty. "The subpoena directed me to appear in Coquille," Frasier said. "I don't know what Mr. Terry is doing."

Frasier has also recused himself from the case because of a conflict of interest. His wife was the head coach of the Coquille High School track team in 2006. Boutiette, an assistant that season, has also coached some of Frasier's children.

Frasier said his copies of the photos have been turned over to Shannon Sullivan, deputy district attorney in neighboring Douglas County. Sullivan told The Register-Guard she has yet to review the pictures.
